These General Terms and Conditions of Sale are governed by the Consumer Code (Legislative Decree no. 206/2005), Section II, Distance Contracts (articles 50 – 67), as amended by Directive 2011/83 EU implemented by Legislative Decree of December 3, 2013, and by the rules on electronic commerce (Legislative Decree no. 70/2003), and apply to the sale of Products via the Internet, as identified and listed on the Website. The Customer is invited to print or save these General Conditions using their preferred method. In the event of changes to the General Conditions, the purchase order (hereinafter referred to as the “Purchase Order”) will be subject to the General Conditions published on the Website at the time the Order is submitted by the Customer. By placing an order, the Customer declares to have read, understood and accepted these Terms and Conditions of Sale.

The following sales conditions govern distance purchases of goods offered on the sunglasses.shop website. By placing an order through the website, the customer accepts the following conditions and declares to have read them.

1) Shipping

sunglasses.shop uses the best carriers in the industry to ensure your order is delivered on time.

Shipping will be carried out after payment is received.

Delivery times may vary if the recipient’s address is in a remote area and/or island.

Factors such as postal or courier delays, logistical issues, adverse weather conditions, or the inability of our couriers to reach the recipient at the address provided during checkout (due to incomplete or incorrect information) may affect delivery times.

We do our best to ensure orders are delivered within the expected dates, but occasionally there may be delays, particularly during busy periods (sales and holidays).

Any delays or failed deliveries by the courier are not directly attributable to LDA FASHION SRL.

We will do our best to keep you updated on delivery status and you will still be able to track your parcel via the tracking number provided, to be entered on the courier’s website.

We do not ship to P.O. Boxes, only to physical addresses.

2) Prices

The product prices displayed include VAT and may be changed at any time.

Furthermore, during checkout and before payment, the total order cost will be summarized and can still be modified or canceled entirely.

3) Liability and Warranty

LDA FASHION SRL is not responsible for any direct and/or indirect damage or loss resulting from the sale of items published in the catalog, nor for delayed and/or failed delivery, nor for any other event not directly attributable to our company.

LDA FASHION SRL does not accept liability for lost items after delivery has occurred, nor for any damage resulting from the use of clothing, footwear, and accessories.

The warranty terms applied are those provided by the manufacturer. It is the Customer’s responsibility to verify the quantity and condition of the goods at the time of delivery.

If the Customer finds that the goods are damaged or do not match the ordered quantities, they must report this to the courier and sign the delivery document with reservation, as well as inform LDA FASHION SRL within 3 days of receiving the shipment. LDA FASHION SRL will then (once it verifies that the returned Product(s) is/are intact, in the original packaging, complete with all parts – including packaging and accessories) replace the missing or damaged goods in accordance with the Purchase Order placed.

5) Returns and Refunds

Pursuant to Legislative Decree no. 206/2005, the customer has the right to withdraw within 14 days from receipt of the order.

Shipping costs are to be borne by the customer.

The returned product must be intact, undamaged, not used or washed, with the original label and box if provided.

You can request a return via your account page or by emailing customer service at info@sunglasses.shop with your order number and reason for return.

The refund in case of return will be issued within 14 days of receipt of the returned item. All accessory charges paid (shipping) are excluded from the refund.

For shipments to countries that do not use the euro (€) as local currency, additional currency conversion costs may apply. These costs are the responsibility of the customer and will be calculated based on the policies of the payment provider or bank used.

Order cancellations are only permitted before shipment. Once the order has been shipped, it can no longer be canceled.

6) Product Availability

sunglasses.shop reserves the right to accept or decline any orders placed, in any case until the stock runs out. In the event of a rejected order (e.g., unavailable item), following an informative email, we will offer you a refund of the amount paid or the option to choose an alternative product.

7) Use of Images

The images on the sunglasses.shop website are the property of LDA FASHION SRL. Any use of these images without written consent from LDA FASHION SRL will be prosecuted according to law.

8) Sensitive Data

Your credit card data is managed by the PayPal service. LDA FASHION SRL and its operators will never access this information. If you choose PayPal as a payment method, please read the terms of service carefully on the relevant website.

10) Alternative Dispute Resolution (ADR) / Online Dispute Resolution (ODR)

EU Regulation no. 524/2013 and Legislative Decree no. 130/2015 introduced rules aimed at promoting the out-of-court settlement of disputes between consumers and traders regarding products or services purchased online. For this purpose, a European Online Dispute Resolution platform (so-called ODR platform) has been created, accessible at http://ec.europa.eu/consumers/odr/. Through the ODR platform, consumers can file a complaint regarding a contract concluded online with LDA FASHION SRL and thereby initiate the online dispute resolution process. The steps are 4:

– creation and submission of the complaint

– agreement on the resolution body

– handling of the complaint by the resolution body

– resolution and closure of the complaint.

11) Applicable Law, Jurisdiction and Competent Court for Non-Consumer Users

These Conditions are subject to Italian law. For all orders placed by entities that cannot be classified as "consumers", any disputes regarding the interpretation and/or execution of this contract shall be under the exclusive jurisdiction of the seller’s local court.

For consumer customers, the competent court shall be the court of the consumer’s place of residence.
